We are proud to announce that our latest article, “The Fitness of Arbitration in Resolving Crypto Disputes: An Uneasy Fit,” has been published in Principia (Issue 10, 2024), the prestigious journal by Universidad Monteávila’s Centre for Research and Studies on Dispute Resolution.
In this piece our team, Soham Jethani, Pankhuri Malhotra, and Abhay Raj explore whether arbitration is truly equipped to handle the complexities of disputes in the cryptocurrency sector. This article offers a fresh practitioner’s perspective and sheds light on the challenges and potential pathways forward.
Abstract:
Over the past decade, arbitration has become a preferred method for resolving commercial disputes compared to traditional litigation. This trend extends to the cryptocurrency sector, where disputes involving virtual assets and blockchain technology are increasingly submitted to arbitration. While scholars have widely discussed the benefits and general concerns associated with arbitration and crypto disputes, the authors, through the present article, present a practitioner’s viewpoint that has not yet been explored within the crossroads of arbitration and crypto disputes. As such, the authors argue that despite the perceived benefits of arbitration, it is not ‘fit for purpose’ for resolving crypto disputes.
