Digital asset businesses collect and process significant quantities of personal data, from KYC records and wallet analytics to transaction histories and device identifiers. That data is subject to privacy law in every jurisdiction where it is processed or where data subjects are located, and the obligations attach regardless of whether the business is regulated for financial services purposes.

TLP Advisors advises on data mapping, privacy gap assessments, documentation programmes, data processing agreements, and breach response for virtual asset businesses, exchanges, custodians, wallet providers, and Web3 protocols. We also provide legal review of smart contracts, covering enforceability, admin rights, governance controls, and user-facing obligations.

Common questions

Data protection and smart contracts, answered

Questions we work through with compliance teams, CTOs, and legal counsel.

Yes. The UAE Federal Data Protection Law and the DIFC and ADGM data protection frameworks each apply to the processing of personal data within their respective jurisdictions. Virtual asset businesses that collect KYC data, process transaction data, or use blockchain analytics tools will be processing personal data subject to these frameworks.

Public blockchain addresses are generally treated as pseudonymous rather than anonymous. Where an address can be linked to an identified or identifiable individual, the associated on-chain data becomes personal data for privacy law purposes.

A data processing agreement is required. The scope of data processing, purposes, retention periods, sub-processing arrangements, and data subject rights must all be addressed. Cross-border transfer mechanisms are also required where the analytics provider processes data outside the relevant local jurisdiction.

A legal review assesses whether the contract creates enforceable legal obligations, who has admin rights and what those rights allow, whether upgradeability mechanisms could alter user rights without notice, how oracle dependencies are managed, what user disclosures are required, and how liability is allocated between the protocol and its users.
